Wednesday July 26, 8:48 PMMan, state ordered to pay over sexually harassing female worker(Kyodo) _ The Tokyo District Court on Wednesday ordered a man working at the health ministry's local office in Tokyo and the state to pay a total of 550,000 yen in compensation over the defendant's sexual harassment of a female worker by forcing her to pluck his beard.Judge Masaki Katano said, "The request itself notably lacked appropriateness, and continuing to make the request even though the plaintiff was clearly refusing to do so is an illegal act that goes beyond moral criticism." The judge also recognized the state's liability as employer. According to the ruling, the man repeatedly asked the woman to pluck his growing beard around November 2004 when she was a temporary worker at the local office affiliated with the Health, Labor and Welfare Ministry's Employment Security Bureau. The woman, who is in her 30s and is from Kanagawa Prefecture, refused, saying that he should do it himself, but the man forced her to pluck his beard, the ruling said. The man also summoned the woman to a reception room in October 2004, thinking that she had criticized him for taking days off, and yelled at her for nearly 20 minutes saying she should tell him directly about any discontent. The man had been given a strict warning by the bureau chief for sexually harassing the woman on a different occasion. A bureau official said that the ruling was "harsh" in that the state's employer liability was recognized. "We will consider how to deal with this issue after examining the ruling," the official said. The woman had filed a lawsuit against the man and the state seeking a total of 5 million yen in compensation. |
