The men could be executed by firing squad once all documents were prepared and it was not necessary to wait to see if they wanted to ask for a presidential pardon since they had already turned down that option, Hendarman Supandji said. However, a lawyer for the three men said they could still decide to ask for clemency. The three Islamic militants -- Amrozi, his brother Mukhlas alias Ali Ghufron and Imam Samudra -- have been on death row since 2003, when a Bali court sentenced them to death for their roles in the nightclub bombings that killed 202 people. Bali's Denpasar District Court said on Friday the Supreme Court has rejected their third appeal for a case review. "If it (the rejection) is true, then legally the death sentence already has unequivocal legal power and (we) can proceed with the execution," Supandji said, adding that his office was awaiting a letter from the Supreme Court to be relayed to it from the Bali court to confirm the appeal had been rejected. "There was a question if they wanted to appeal for clemency but it was rejected," he added. He did not specify a date or time for the execution, but said security would be a factor in preparations. A lawyer for the bombers said the men, who have repeatedly told the media they are ready to die as martyrs and will not seek clemency, could still decide to seek a pardon. "We will ask them later whether they will use their right to ask for a pardon or not," Mahendradatta, the lawyer, said. An official at Bali's Denpasar District Court also said the Supreme Court letter would be sent to the families of the men to see if they wanted to request a pardon. The Supreme Court turned down their third appeal for a case review, saying convicts can only appeal for a case review once. Indonesia does not make public the timing and exact location of executions, but a deputy attorney-general in May said it would be done in Central Java. They are being held in a maximum-security jail on Nusakambangan island off Central Java, hundreds of kilometres from their families who live in East and West Java. Australia's Prime Minister Kevin Rudd, whose country lost 88 citizens in the blasts, said while his centre-left government opposed the death penalty, it would not intervene. "In the case of foreign terrorists we are not in the business of intervening on any of their behalves," Rudd told journalists. |
